If the POA is to be used in a foreign country — to authorise someone to act at an overseas bank, government office, or court — it must be authenticated by the Ministry of Foreign Affairs (MoFA) at Singhdurbar after notarisation. For Hague Convention member countries (USA, UK, Australia, EU countries, India), an apostille from MoFA is required. For Gulf countries (UAE, Qatar, Saudi Arabia, Kuwait), embassy attestation on top of MoFA attestation is typically required. If you are currently abroad, you cannot sign before a Nepal-registered Notary Public in person. However, you have two options. First, you can have the document notarised at the Nepali Embassy or Consulate in your country of residence, which has the authority to perform notarial acts for Nepali citizens abroad. Second, if your country permits, you can have the document notarised by a local notary and then have it apostilled and sent to Nepal. In Nepal, a power of attorney that is not notarised by a registered Notary Public is not legally valid for most formal purposes. Banks will not accept an un-notarised POA to operate accounts. The Land Revenue Office will reject un-notarised POA for property transactions. Courts require notarised POA for legal representation. Under the Notary Public Act 2063, notarisation gives the document official legal status. Having a document "drafted" without notarisation creates a document that appears official but cannot be legally acted upon — avoid this at all costs.

Yes. When one parent is travelling abroad with a minor child and the other parent is not accompanying them, most countries require a notarised consent letter or parental POA granting the travelling parent authority to make decisions for the child.
